457 visa to 856 visa
The 856 visa allows employers to sponsor or assist employees on a 457 visa a pathway to progress to permanent residence while remaining in Australia. This is particularly important for overseas employees who are over 45 and can address exceptional circumstances for their age.
The key requirements for this visa which you must meet at the time the application is lodged are as follows:-
- you must be the holder of an eligible visa - for which the 457 is one.
- your occupation must be on the gazetted ENSOL list.
Other eligibility requirements:-

You must have worked in a full-time position in Australia in the occupation (mentioned above) on a Subclass 457 visa (or another specific temporary visa) for the last two years prior to the visa application being made and have worked at least for the last 12 months for the employer that is sponsoring you OR;
- be in a highly executive position with a base salary of more than $165 000 per year; OR

have had your skills assessed as suitable by the appropriate skills assessing authority and have at least three years full-time work experience in the occupation before the visa application is lodged (unless there are exceptional circumstances)
- your employer must be prepared to sponsor you for permanent residence
- show that you have the appropriate skills, qualifications and/or experience to fill the position
- If you need to be licensed or registered, then you must already be so (e.g. registered nurse, electrician etc.)
- be under 45 years of age (unless exceptional circumstances apply)
- provide a contract confirming your remuneration, postion, employment terms etc.
- have vocational English language ability (i.e. IELTS of at least 5.0 in each band unless there are exceptional circumstances)
- you will also need to meet the health and charcter requirements for a permanent visa.
